On February 18, Phillip Stone filed a lawsuit in Clay County Circuit Court against Atlas Railroad Construction LLC, Genesee & Wyoming Inc. and Consol Energy, citing deliberate intent and unsafe workplace. The lawsuit claims that while employed with Atlas Railroad, he was assigned to work at Consol Energy. Stone alleges while working at Consol and using a chainsaw to clean debris, the chainsaw hit his knee, causing serious injuries. Stone is accusing the defendants of being negligent by failing to provide proper training, failing to perform a job safety analysis, failing to provide proper personal protective equipment, failing to provide supervision and failing to perform a personal protective equipment hazard assessment.
