The regularly scheduled County Commission meeting was held on May 13, 2015. To open, the commissioners approved the minutes from the previous meeting and approved the bills and purchase orders as presented. Mark Toor’s Attorney fees in the amount of $9,200.00 were approved to be paid. The Erroneous Assessments as presented by the Assessor were approved.
The commissioners then removed an item from the agenda. The item removed was to amend the 2014 assessed value for the following tracts: Moses Gas Inc. Ticket No. 303642, 303643, 303644, and Ticket No. 303645. The item was removed until the rest of the paperwork is received.
The “Request of Waiver of Final Settlement” for the estates of Lynnette Beets, Sammy R. Douglas, Florence Fern Rose, Jessie Childers, Paul Edward Hagerman, Shelby Nottingham, Fred D. Nichols, Margery G. Nichols, Frances JoAnn Dickson and Richard lee Metheny, deceased was approved. The commissioners then voted on a “Final Settlement Report” for the estate of Letty Marie Moore, deceased and discharge of Carolyn Murphy, Executrix. The approval to confirm probating the Last Will and Testament of Thomas Charles Coulter and the appointment of Mark William Coulter, Executrix was next. Then, the commissioners confirmed probating the Last Will and Testament of Lowell Paul Smith and the appointment of Todd Smith, Executor. The approval of the appointment of Amy Thompson, Administratrix of the estate of Robert M. Godbey, deceased; the appointment of Rebecca Woodrum, Administratrix of the estate of James Woodrum, deceased; the appointment of Peggy Ann Lowe, Administratrix of the estate of Troy Pegas Neff, deceased; and to appoint Glen Sutton, Fiduciary Commissioner for the estate of William Glen Francis, deceased was agreed upon by the commissioners.
Proceeding with the meeting, the commissioners approved Quincy Potasnik Mitchell as a board member of the Clay County Business Development Authority for a term expiring May 13, 2018. The Clay County BDA requested to use the Courthouse Courtyard, inside facilities and restrooms, and side parking lot beside Rite-Aid for the Elk River Fest to be held on June 5, 2015 and June 6, 2015. A certificate of Liability with the County Commission listed as an additional insured will be required. That requested was approved. The BDA has a valid Certificate of Liability and will not need a new one until next year’s Elk River Fest.
A request by the Clay County BDA and Michael Shamblin, Extension Agent, to use the Courthouse Courtyard for the 2015 Farmers Market was approved. The market will be held on Thursdays from 12:00 pm to 4:30 pm, beginning on June 4th and ending in mid-October. A Certificate of Liability with the County Commission listed as an additional insured will be required. That Certificate is in place to be presented to the commissioners. The Farmer’s Market is in their 5th successful year and they hope that changing from Saturdays to Thursdays that they will be even more successful.
The approval of Service Contracts prepared by Appalachian Office Products for a C9020 Savin Copier and LD245 Lanier Copier located in the Circuit Clerk’s office was next. The service contract is for April 29, 2015 through April 28, 2016.
The commissioners then approved the hiring of Tyler C. Caruthers as a full-time Deputy Sheriff effective May 13, 2015 at the rate of $1,875.00 per month with benefits. Tyler will be on probation for a period of one year and will work at the will and pleasure of the Sheriff.
The meeting ended with committee reports. The BDA sold a piece of property in Wallback to Josh Shamblin and the Sheltered work-shop in the about of $65,000 to be paid in payments over 4 years. Also, the H.E. White Ramp dinner was a huge success and brought in over $8,000.
