Ballas Beasley, a resident of Maysel, is suing the West Virginia Department of Transportation Division of Highways for a 2013 accident. According to the lawsuit filed in Clay Circuit Court, Beasley claims he was traveling northbound on State Route 4 in February of 2013 when he met oncoming traffic partially in his lane. Beasley alleges that he was forced to hug the shoulder of the road to avoid the oncoming traffic, at which time his vehicle struck a large sign beside the roadway. Beasley declares the sign was placed too close to the road by the DOH, blocking the shoulder. The sign had been placed along the road to warn drivers of the upcoming roadwork.
Beasley crashed his car, which resulted in injuries that required transportation to the hospital by helicopter. The plaintiff claims that as a result of the accident, he suffered injuries to his head, neck, shoulders, back and legs. Citing physical injury, pain and suffering, medical bills and out of pocket expenses, the plaintiff seeks judgment in the form of damages, pre- and post-judgment interest, attorneys’ fees and costs.
