Clay County has dropped the felony charges against Jason Rollyson, the man accused of taking pictures of a young boy in the bathroom of a gas station. Rollyson appeared in court on Thursday to face charges of prohibiting child erotica and use of minors in filming sexually explicit conduct prohibited. According to Assistant Prosecutor Dan Dotson, the felony charge of the use of minors in filming sexually explicit conduct reads that the child has to be engaged in a sexual act in order for that charge to be appropriate. Since this wasn’t the case in the Rollyson crime, the court was forced to drop the felony charge. Rollyson remains in Central Regional Jail where he is being held on $20,000 cash only bond for the misdemeanor charge of prohibiting child erotica.
