For the third time since the lawsuit was filed, the hearing for the case of Jim Samples, Prosecuting Attorney vs. The Clay County Commission has been postponed. With attorneys present for each side, both the plaintiff and the defendants appeared before the Honorable Judge Richard Facemire Wednesday morning to hear his verdict regarding the legality of the budget cuts made by the county commission to the prosecuting attorney’s office. However, Lonnie Simmons, attorney for Prosecutor Jim Samples, had recently filed a motion to amend the current complaint. Due to this issue, it was determined that neither side was prepared to go to trial. Judge Facemire rescheduled the hearing for Tuesday, September 30 at 9:00. At this time, arguments from both sides will be heard as well as witness testimony and the display of exhibits.
