Gould’s Electric of Indore, WV was forced to file a lawsuit last month in Clay County Circuit Court against White Wine Mining for non-payment of purchased equipment. According to the complaint a contract was signed stating that Gould’s Electric Motors was to deliver mining equipment that White Wine Mining had agreed to purchase and White’s would pay for each piece of equipment upon receipt. In February 2013, Gould’s delivered a $7,420 motor to the company. Two months later another motor was delivered for a cost of $2,650. In September of 2013 a third motor was delivered to White Wine Mining, resulting in an additional cost of $1,740. The total amount of equipment delivered to White’s is $11,270. The invoices have remained unpaid and Gould’s Electric feels White Wine Mining breached the implied contract to pay for the equipment.
White Wine Mining is also accused of intentionally and negligently misrepresenting their intention to pay. Gould’s is seeks $30,000 plus pre-judgment and post-judgment interest at the statutory rate, as well as attorney fees and court costs.
